    "Section 889
    In relation to acquisitions (contracts), we issued revisions to ADS Chapter 302, USAID Direct Contracting and New ADS Mandatory Reference: ADS 302mbp, Waivers for Covered Telecommunications and Video Surveillance Services or Equipment under FAR 4.2104 on August 10th. Additionally, we issued Implementing Partner Notice (IPN) #7 on Indefinite Delivery/Indefinite Quantity (IDIQ) contracts to assist with Section 889 related modifications on August 11th. We are preparing an additional IPN on Blanket Purchase Agreements (BPAs) that should be released very shortly.

    On the assistance side (grants/cooperative agreements), OMB published the final 2 CFR rule yesterday, August 13, revising several sections of OMB Guidance for Grants and Agreements, including 2 CFR 200, which included elements related to Section 889. We are working diligently to issue revised policy in ADS 303, reflecting the Section 889 statutory prohibitions, including a new standard provision. We are hopeful that these revisions to ADS 303 will be published within the next few days along with some additional insights.

    We continue to work within the Agency and the inter-agency to advance better understandings, interpretations and other abilities. We will be setting up additional Implementing Partner (IP) engagements to be responsive to questions and share further updates as additional information unfolds.
